ارتباط الصفقات العمومية بالتشريع المعمول به في القانون الجزائري

Résumé: تعد الصفقة العمومية عقدا من العقود الإدارية التابع للقانون العام وما يمنحه هذا القانون من امتيازات خاصة بالنسبة للمصلحة المتعاقدة في مجال إبرام هذا النوع من العقود و ما يتميز به من أحكام تميزه عن قواعد القانون الخاص خاصة في مجال إبرام العقود وبالتالي يبدو وجود استقلال بين القانونين، إلا أن تحليل قانون الصفقات العمومية يظهر مدى التأثر و الارتباط بأحكام القانون الخاص خاصة القانون المدني باعتباره الشريعة العامة للعقود مثل أركان العقد ( التراضي، المحل، السبب)، عيوب الإرادة، ومنه يتضح أن استقلال عقد الصفقة العمومية عن أحكام القانون الخاص هو استقلال نسبي. الكلمات المفتاحية: الصفقة العمومية، القانون الخاص، التشريع المعمول به، عقود الأعمال. A public transaction is considered a contract of the administrative law, of the common law and the concessions granted to it by this law especially with regard to the contracting interest in the field of concluding the type of contract and its provisions that distinguish it from the rules of private law, and therefore it is clear in principle that there is independence between the two laws, except That the analysis of the law of public deals shows the extent of vulnerability and correlation with the provisions of the private law, especially the civil law, as the general rule of contract such as the pillars of the contract, consensual, the subject, the cause, defects of the will and from it becomes clear that the independence of the public deal contract from the provisions of the private law is relative and guardian independence entirely.
