اتفاقية العمل الجماعية مصدر لقانون العمل

Résumé: تعتبر اتفاقية العمل الجماعية من المصادر المهنية لقانون العمل، حيث يمثل دمجها في النظام القانوني للدولة مسألة مركزية وأصلية لقانون العمل،فلم تعد الدولة المصدر الوحيد لإنشاء القانون. وتقوي اتفاقية العمل الجماعية النظام القانوني للدولة على اعتبارها كمنتوج يصدر عن التفاوض الجماعي، وكوسيلة تجد أساسها في الاستقلالية الجماعية . بالإضافة إلى الدور المسند لاتفاقية العمل الجماعية والمتمثل في تكملة التشريع، والترقية الاجتماعية. ولا يمكن تجاهل تنازع اتفاقية العمل الجماعية مع المصادر الأخرى لقانون العمل كالتشريع، والتنظيم، وعقود العمل الفردية، والنظام الداخلي....الخ. وترتكز علاقة اتفاقية العمل الجماعية مع المصادر الأخرى لقانون العمل على البحث عن النظام والانسجام الذي يتضمن إظهار النظام التدرجي، وحل التنازع المطروح بينهم من خلال تحديد القاعدة المطبقة في حالة تنازع مصدرين أو أكثر. Abstract: Collective labor agreement is considered as one of the professional sources of Employment law. Given the fact that adding this agreement to the state legal order constitutes a central and fundamental issue in Employmen law, the State constitutes no more the sole law producing source. Collective labor agreement strongly backs up the established state legal system. As part of collective bargaining, it is founded on collective autonomy.Hence its role in completing the law and in social progress, though its conflicting with other sources of Labor laws such as the law, regulations, individual work contract and internal rules and so on and so forth cannot be ruled out. Combining collective labor agreement with other sources of law allows the parties to focus on order, harmony and a hierarchical classification as much as on the settling of conflicts between norms and the working out of a principle applicable to conflict resolution between one or several sources of law.
