تفويض المرفق العمومي عن طريق عقود الامتياز
Résumé: نتج عن ظهور المرافق العامة الاقتصادية تعدد طرق إدارة المرفق العام، ففي الأصل كانت تدار المناطق العامة الاقتصادية مباشرة من قبل الدولة، إلا أن الطبيعة الاقتصادية للمرفق العام لا تتلاءم مع طبيعة العمل في الإدارة العامة، لذلك تم اللجوء إلى أساليب الخاصة أبرزها التفويض عن طريق عقد الامتياز. إلا أن تفويض المرفق العمومي عن طريق إليه الامتياز لا يعني تخلي الشخص العام (الإدارة) عن المرفق العام كليا، بل يبقى من حسني إدارته وتامين استمرارية تشغيله، لذلك تمارس رقابه على إدارة هاته التقنية (التقويض عن طريق الامتياز) في تسييرها للمرفق العمومي Abstract: The emergence of economic public utilities has resulted in multiple methods of managing public utilities. Economic utilities were originally administered directly by the State, however, the economic nature of the public utility is incompatible with the nature of the work. Therefore, special methods have been resorted to, most notably authorization through a concession contract. However, the delegation of the public facility through the concession mechanism does not mean that the general responsible (administration) has abandoned the general facility altogether, But, He/she remains responsible for his/her management and for ensuring continuity in his/her operation, thus exercising control over the management of this technology. (concession contract) in its application to the public utility
