تفويضات المرفق العام بين الفعالية والمحدودية على ضوء المرسوم التنفيذي 18/199، Public Utility Delegation; Between Effectiveness And Limitation, In The Light Of The Executive Decree No. 18-199

Résumé: تعد عقود تفويض المرفق العام أهم الحلول الفعالة إلى حد ما في التنمية والاستثمار العمومي، لاسيما أن المرفق العام يعتبر جوهر وظيفة الدولة، ومظهر من مظاهر السيادة، بحيث يرتبط بها وجودا وعدما. لذلك نجد أنّ المشرع الجزائري قد تبنى أسلوب التفويض كإحدى أهم الوسائل لإشباع الحاجيات العامة للجمهور من خلال المرسوم التنفيذي 18/199 منظما لجميع جوانبه القانونية والاجرائية لاسيما تلك المتعلقة بأشكاله، كأحد البدائل للنهوض بالاقتصاد الوطني والبحث عن طرق جديدة للتمويل العمومي. The contracts of Public Utility Delegation are considered, to some extent, the most important of the effective solutions in development and public investment, especially because the public utility is considered the heart of State role, and a manifestation of sovereignty, as it is a condition of its existence. That is why we find that the Algerian legislator adopted the method of delegation, as one of the most important means of fulfilling the general needs of people, through the Executive Decree No. 18-199, which regulates all the legal and procedural aspects of delegation, especially the ones related to its forms, as a substitute to promote the national economy and searching for new ways of public financing.
