إجراءات تحرير عقد الشفعة المتعلقة بحصة شائعة من عقار شائع في التشريع الجزائري

Résumé: ملخص: تعتبر الشفعة الطريق الثاني الممنوح للشركاء على الشيوع لطرد الأجنبي من بينهم والحلول محله في التصرف بالبيع الصادر من أحد الشركاء في الشيوع على عقار شائع، فهي بما تمثله تعد قيد على حرية التعامل،وتعتبر إستثناء عن الأصل،مما أدى بعض التقنينات إلى عدم الأخذ بها وإستبعادها مثل القانون السوري، إلاّ أن غالبية التشريعات أخذت بها على غرار القانون المدني الجزائري وبالضبط في مادته 794.
