طرق البحث والتّحري الخاصة بالجريمة الجمركية

Résumé: نظرا للخطورة التي تشكلها الجريمة الجمركية على الجانب الأمني و الإقتصادي للدولة أجبر المشرع الجزائري على التوسيع من مجال الصّلاحيات. والسّلطات المخولة لأعوان الجمارك في إطار البحث والتّحري عن هذه الجرائم، فبالإضافة إلى الصّلاحيات المخولة لضباط الشرطة القضائية في مجال البحث و التحري عن جرائم القانون العام بصفة عامة، والجرائم الجمركية على وجه الخصوص، تم تمكين أعوان الجمارك من صلاحيات أخرى والتي يمكن حصرها في كل من إجرائي الحجز والتحقيق الجمركيين، إضافة إلى سلطة أخرى يخولها لهم القانون المتعلق بمكافحة التهريب عند مباشرتهم عملية معاينة جرائم التهريب والتي تتمثل في التسليم المراقب، كل هذا من أجل إحتواء هذه الجرائم، وتضييق الخناق عليها لردعها والتخفيف من حدة آثارها الوخيمة. Due to the gravity of customs crime on the security and économic aspect of the state, the algerian legislator was obliged to open the field whithin , the powers and the authorities Authorized to the customs agents in In framework of research and investigation of these crims , in addition to the powers vested in the judical police officers in the field of research and investigation for crimes of public law in general and customs offenses in particular. Customs agents have other powers, which consists of both the criminals of the arrest and the customs investigation , in addition to another authority empowered by the the law to combat smuggling when they are in the process of inspeeting smuggling crimes , which is represented by controlled delivery, all this in order to contain these crimes and tighten the screws on them to deter and mitigate its adverse effects.
