التسرب كإجراء مستحدث لمكافحة الجرائم الماسة بأنظمة المعالجة الآلية للمعطيات .

Résumé: ملخص: تم من خلال دراسة هذا الموضوع التطرق الى أهم آلية المقررة لمكافحة الجريمة المعلوماتية بعد استحداثها بموجب المادة 65 مكرر 12قانون الإجراءات الجزائية والمتمثل في إجراء التسرب، بحيث أن المشرع لجا إلى هذا الأسلوب بعد فشل الأساليب التقليدية في تحقيق النتيجة المرجوة منها. ويعد التسرب إجراء فعال في مكافحة الجريمة والكشف عن العناصر الإجرامية من خلال توغل ضابط الشرطة او العون المكلف بالبحث عن الأدلة والحقائق التي تساهم في إدانة أعضاء المجموعة المتوغل فيها، حيث تم من خلال هذه الدراسة الاستعانة بالمنهج التحليلي من خلال ابحث عن الشروط والمراحل والإجراءات المساهمة في عملية التسرب، بعد ذلك الوقوف علة أهم النتائج وإعطاء توصيات تساهم في تطوير مجال تطبيق عملية التسرب. الكلمات المفتاحية: الجرائم الالكترونية المستحدثة ـــ المنظمة الإجرامية ــ وكيل الجمهورية ـــ ضابط الشرطة المنسق ــ العون المتسرب Summaru : This study has been addressed to the most important mechanism established to combat information crime after its introduction under article bis 12of the code of criminal procedures ,which is the leakage procedure, so that the legislator resorted to this method after the failure of the traditional methods to achieve apositive result ;leakage is an effective measure in combating crime and detecting criminal elements through the incursion of the police officer or the assistant in charge of the search for evidence and facts that cintribute to convicting the members of the criminal group ,In this study the analytical approach was used by addressing the legal matrials related to the condition and procedures for contributing to the leakage process, then standing at the most important results and giving recommendations that contribute to the development of the field of application of the leakage process Keywords :new electronic crimes,criminal organization ,republic agent , coordinating police officer,leaked help
