التراخيص الإجبارية للصحة العامة آلية لرفع احتكار الصناعة الدوائية

Résumé: تمنح براءة الاختراع لصاحبها احتكارا في استغلال اختراعه لمدة 20 سنة، خلال هذه المدة الطويلة يمنح له القانون حقا احتكاريا في منع الغير من استغلال هذا الاختراع دون اذنه ،متجاهلا حاجة الغير في الانتفاع منه. و محاولة من المشرع وضع نوع من التوازن بين المصلحة الخاصة(المخترع) و المصلحة العامة(الجمهور) في الاستفادة من اهمية هذا الاختراع من الجانب الاقتصادي و في بعض الحالات الجانب الصحي ،لجأ الى نظام خاص يسمى التراخيص الاجبارية، حالات منح المشرع لهذه التراخيص هي عدم الاستغلال او النقص فيه والمنفعة العامة. تدخل في مفهوم المنفعة العامة الامن الوطني الصحة الغذائية و الصحة العامة ، سنحاول من خلال هذه الدراسة التطرق الى هذه المجالات و تحليلها .The patent is granted to the inventor, giving him a monopoly on the exploitation of the invention for a duration of 20 years, and within this period, no other exploitation can be made without the autorisation of the patent owner. The legislator reserved dispositions concerning the compulsory licence in order to equilibrate between the public intereset and the inventor’s intereset, by economic exploitation, and in order to ensure the availability of pharmaceutical products, in case of patents related to health. Thus, the granting of the compulsory licence arises in case of non-exploitation of the invention, insufficiency of exploitation, and also, if the public intereset is concerned. The latest covers severl areas, including national security and public health.
