دور القاضي أثناء إجراء الصلح بين الزوجين

Résumé: ملخص : يعتبر الصلح واحدة من أهم الآليات التي يقوم بها قاضي الاسرة، والذي يقع على عاتقه بذل كل الجهد للإصلاح بين الزوجين بموجب مجموعة من الصلاحيات القانونية والقضائية. غير أن عمل القاضي الأسري في هذا الاطار تعترضه العديد من العقبات ذات الصلة بالتنظيم التشريعي للصلح في حد ذاته، أو معيقات يفرضها واقع الممارسة القضائية وغيرها. ومن أجل تحقيق الأهداف المرجوة من جلسات الصلح، وفي سبيل انجاحها أمام مختلف العقبات التي تعيق عمل القاضي اثناء اجراء الصلح، حيث حددت دراستنا أهم هذه العوائق ومسبباتها ثم توصلت إلى التعرف على أهم سبل تفعيلها إيجابيا لإنجاح دور قاضي الأسرة في الصلح اقتداء ببعض التجارب الدولية الناجحة في هذا المجال. Abstract : Reconciliation is one of the most important mechanisms that a family judge performs, who makes efforts to reform between the spouses due to a set of legal and judicial powers. However, his work in this context is faced by many obstacles related to the legislative organization of conciliation itself, or other practical obstacles. In order to achieve the goals behind the conciliation sessions, and in order to make it successful, our study has identified these most important obstacles and their causes, and then identified the most important ways to activate them positively to make the role of the family judge in the conciliation successful following some international related experiments.
