حماية المنتجات الدوائية بموجب نظام المعلومات غير المفصح عنها وفقا لاتفاقية تريبس

Résumé: جاءت اتفاقية تريبس بآليات من أجل حماية المنتجات الدوائية تنسيقا بين حقوق مالكي هذه المنتجات و حقوق مستهلكيها أو المحتاجين لها ، و من أهم الأنظمة التي كرستها نجد نظام براءات الاختراع و نظام المعلومات غير المفصح عنها ، و قد استحدث هذا الأخير صراحة بموجب اتفاقية تريبس ، أين نظمت نطاق المعلومات الدوائية التي يمكن المطالبة بحمايتها و صنفتها إلى صنفين ، و أوجبت شروطا عامة ينبغي توفرها في هذه المعلومات أو يجب اتباع اجراءاتها من أجل ضمان الاستفادة من هذه الحماية ، و شروطا خاصة تتعلق أساسا بالمنتجات الدوائية نظرا لما لها من خصوصية و ما لها من مراحل معقدة يجب المرور بها من أجل الوصول إلى هذه المنتجات ، و كذا تسويقها و طرحها أمام مستهلكيها. The TRIPS Agreement came with mechanisms for the protection of pharmaceutical products in order to harmonize the rights of the owners of these products and the rights of their consumers or those in need, and among the most important systems enshrined in it, we find the patent system and the undisclosed information system, and the latter was explicitly introduced under the TRIPS Agreement, where It organized the scope of the drug information that can be claimed protection and classified it into two categories, and it dictated general conditions that should be met in this information or that its procedures must be followed in order to ensure benefiting from this protection, and special conditions related mainly to pharmaceutical products due to their privacy and what they have Complex stages that must be passed in order to reach these products, as well as to market and present them to their consumers.
