Résumé: يعتبر القصد الجنائي الخاص في جريمة الإبادة الجماعية المعيار المميز لها، فبمجرد توافر نية الإهلاك الكلي أو الجزئي لجماعة قومية أو إثنية أو عرقية أو دينية، مع ارتكاب أحد الأفعال المحددة على سبيل الحصر الواردة بالمادة 6 من النظام الأساسي للمحكمة الجنائية الدولية تقوم المسؤولية الجنائية الفردية على عاتق مرتكب هذه الجريمة، لكن من الناحية الواقعية فالحالات التي تم فيها العقاب على هذه الجريمة على مستوى القضاء الدولي الجنائي محدودة وقليلة جدا مقارنة بالعقاب على بقية الجرائم التي تختص المحكمة الجنائية الدولية بالنظر فيها، ولعل أكثر ما يثير الصعوبة في العقاب على جريمة الإبادة الجماعية هو إثبات هذا القصد الخاص.
