Résumé: الملخص: أدرجت السلطات العمومية في المرسوم الرئاسي 15-247 كل المعايير التي من خلالها تتمكن المصلحة المتعاقدة من معرفة ما هي الإجراءات الواجب اتخاذها في مرحلة الإبرام والتنفيذ، ونخص بالذكر الإجراءات الشكلية التي تأخذ أصلا صيغة طلب العروض بشتى أنواعه وإستثناءا صيغة التراضي البسيط أو بعد الاستشارة، أو الإجراءات الخاصة التي تتميز بها بعض أنواع الصفقات سوآءا الاستعجالية أو المتكررة. والهدف من خلال هذه الدراسة هو معرفة إن كانت هذه الترسانة القانونية تتوافق ومتطلبات المتعاملين الاقتصاديين، وعلى هذا الأساس اعتمدنا على المنهج الوصفي التحليلي، وخلصنا على عدة استنتاجات نذكر على سبيل المثال، التطبيق غير السليم لمضمون المرسوم الرئاسي 15-247. Abstract: The public authorities have inserted, through Presidential Decree 15-247, all the criteria on which the contracting service will be able to know what are the procedures to be applied on the award and execution phase, in particular the formal procedures taking the formula mainly the call for offers with its different variants and exceptionally the will is simple and after consultation or specific procedures whether urgent or repetitive. The goal through this study is to find out whether this legal arsenal is compatible with the requirements of economic dealers, and on this basis, we have relied on the descriptive analytical approach, and we came to several conclusions, we mention, for example, the improper application of the content of Presidential Decree 15-247.
