الشرط الجزائي بين القانون الجزائري و الشريعة الإسلامية دراسة مقارنة

Résumé: يترتب عن المسؤولية العقدية أو التقصيرية تعويض يدفعه المدين إلى الدائن و الأصل في تنفيذ الالتزام أن يكون عينيا، وعند تعذر القيام بذلك من طرف المدين ينفذ عن طريق التعويض(التنفيذ بمقابل)، و التعويض قد يكون قضائيا أو قانونيا أو اتفاقيا. التعويض الاتفاقي (الشرط الجزائي )يحدد فيه الطرفان مقدار التعويض الذي يستحقه الدائن عندما لا ينفذ المدين التزامه أو عندما يتأخر في ذلك ، وقد يدرج هذا التعويض في العقد ذاته ، أو في عقد لاحق ويكون هذا التعويض سابق عن الضرر. و الشرط الجزائي هو التزام يتبع الالتزام الأصلي، وهو التزام احتياطي، وللقاضي سلطته تقديرية في تخفيض هذا الشرط أو في زيادته.
