مقال مشترك - إشكالية ترجمة المصطلح المستمد من الشريعة الإسلامية في قانون الأسرة الجزائري – انحلال الزواج والصلح نموذجا

Résumé: الملخص: تهدف هذه الدراسة إلى التعريف بالمصطلح القانوني ومدى تأثر مفهومه بتقنيات الترجمة القانونية، وقد تطرقنا إلى إشكالية ترجمة مصطلحات: انحلال الزواج، الطلاق والتطليق، والصلح والتحكيم بين الزوجين، باعتبارها مصطلحات مستمدة من الشريعة الإسلامية، مع إجراء مقارنة بين النص العربي وترجمته إلى اللغة الفرنسية في قانون الأسرة. وكنتيجة لهذا البحث توصلنا إلى أن أسلوب الترجمة بتقنية الشرح أو التفسير التي اقترحها المترجم في قانون الأسرة لنقل مفاهيم بعض المصطلحات، تؤدي إلى المعنى وتحافظ على التصور الإسلامي للفظ. بينما أسلوب استعارة التسمية التي تبناها المشرع الفرنسي أو الترجمة الحرفية وإن كان يحافظ على شكل المصطلح فهو لا ينقل المفهوم أو التصور بشكل صحيح. Abstract: This study aims to introduce the legal term and the extent to which its concept is influenced by legal translation techniques, and we addressed the problem of translating terms: dissolution of marriage, divorce and and juridical separation, reconciliation and arbitration between spouses, as terms derived from Islamic law, with a comparison between Arabic text and its translation into French in family law. As a result of this research we have found that the method of translation with the interpretation technique, proposed by the translator in the family law to convey the concepts of some terms, lead to maintain the Islamic perception of the word. While the literal translation adopted by the French legislator does not convey the concept or perception correctly.
