استخدام حق النقض (veto) في مجلس الأمن الدولي - إساءة الممارسة وضرورة الإصلاح -

Résumé: ملخص: منذ ما يناهز الخمسة والسبعين عاما، نشأت الأمم المتحدة وجهازها التنفيذي- مجلس الأمن- الذي يعكس من خلال هيكلته ونظامه حالة توازن القوى التي أفرزتها ظروف نهاية الحرب العالمية الثانية، ويظهر ذلك جليا من خلال استحواذ الدول الخمس المنتصرة في الحرب على امتياز الديمومة في المجلس والصلاحيات الممنوحة لها في اتخاذ القرارات أو الاعتراض عليها بموجب ما أصطلح على تسميته بحق الاعتراض (الفيتو). لم تعرف الأمم المتحدة مبدأ أكثر إثارة للجدل والنقاش من مبدأ حق الاعتراض، نظرا لسوء استخدامه من طرف الدول دائمة العضوية والانحراف به خدمة لمصالحها وتحقيقا لأهدافها الخاصة. مما جعل مجلس الأمن يعيش حالة من الشلل في العديد من الفترات، أدت إلى عجزه عن القيام بالمهام المنوطة به للمحافظة على السلم والأمن الدوليين. الأمر الذي جعل الكثير من الدول والخبراء والمختصين يطالبون بشدة بضرورة إصلاح مجلس الأمن وخاصة حق الاعتراض. Abstract: About seventy-five years ago, the United Nations and its executive body - the Security Council - was established, which reflects, through its structure and system, the state of balance of power produced by the circumstances of the end of World War II. This is evident through the acquisition of the five victorious countries in the war, the privilege of permanence in the Council and the powers granted to them to make decisions or object to them under what they called the right to veto. The United Nations has not known a more controversial and debatable principle than the principle of the right to object, due to its misuse by the permanent members and its deviation in order to serve their interests and achieve their own goals. This made the Security Council in a state of paralysis in many periods, which led to its inability to carry out the tasks entrusted to it to maintain international peace and security. Which made many countries, experts and specialists strongly demand the need to reform the Security Council, especially the right of objection.
