أثر تطبيق العقوبات الجنائية على حقوق الأنسان _دراسة مقارنة بين الفقه الإسلامي والمواثيق الدولية _

Résumé: " ملخص تناولت في هذا البحث الموسومٌ ب: ""أثر تطبيق العقوبات الجنائية على حقوق الإنسان: دراسة مقارنة بين التشريع الإسلامي والمواثيق الدولية""، والإشكالية الأساسية التي أحاول الإجابة عنها من خلال البحث تتمحور حول معرفة ماهية العقوبات الجنائية في التشريع الإسلامي والمواثيق الدولية، ومن ثم يليها تطبيق العقوبات الجنائية وأثرها على حقوق الإنسان. وقد جاء الموضوع في فصلين، كل فصل في مبحثين، أما الفصل الأول فيخص المفاهيم الأساسية، وقد خُصِص المبحث الأول منه لماهية العقوبة وحقوق الإنسان وخصائصهما في التشريع الإسلامي، أما المبحث الثاني لماهية العقوبات الجنائية وحقوق الإنسان وأهدافهما في القانون الدولي، فقد خصص الفصل الثاني لتطبيق للعقوبات الجنائية، فكان المبحث الأول لتقسيمات العقوبات الجنائية وعلاقتها بحقوق الإنسان، والمبحث الثاني لتطبيق العقوبات الجنائية وأثرها على حقوق الإنسان. من النتائج الأساسية التي توصلت إليها في بحثي هي ماهية العقوبة وحقوق الإنسان وخصائصهما في التشريع الإسلامي والمواثيق الدولية، ثم يليها تقسيمات العقوبات الجنائية في كلِ من التشريع الإسلامي والمواثيق الدولية، ثم تطبيق العقوبات الجنائية وأثرها على حقوق الإنسان." " Abstract The title of the research is marked with: “The impact of the application of criminal penalties on human rights: a comparative study between Islamic legislation and international covenants”، and the main problem that we are trying to answer through the research in sense of knowing what criminal penalties are in Islamic legislation and international covenants، and then followed by the application of criminal penalties and its impact on human rights. The subject discussed in two chapters، each chapter in two sections. The first chapter deals with the basic concepts. The first section of it is devoted to the nature of punishment and human rights and their characteristics in Islamic legislation. As for the second topic، about the nature of criminal penalties and human rights and their objectives in international law، the second chapter is devoted to the application of For criminal penalties، the first topic was the divisions of criminal penalties and their relationship to human rights، and the second topic was the application of criminal penalties and their impact on human rights. One of the main findings that we reached in our research is the nature of punishment and human rights and their characteristics، as well as their objectives in Islamic legislation and international covenants، followed by the divisions of criminal penalties in both Islamic legislation and international covenants، and then the application of criminal penalties and their impact on human rights."
