شروط إقامة دعوى التعويض الإدارية في مجال التعمير على ضوء التشريع واجتهاد قضاء مجلس الدولة

Résumé: تعتبر دعوى التعويض الإدارية في مجال التعمير من أهم الدعاوى القضائية استعمالا لما تمثله من حماية لحقوق الأفراد في مواجهة أعمال الإدارة المادية والقانونية الضارة، يرفعها المتضرر أمام الجهة القضائية المختصة للمطالبة بجبر مختلف الأضرار. ولقبول هذه الدعوى يشترط توافر مجموعة من الشروط الشكلية والموضوعية، وأن تؤسس على نهوض مسؤولية الإدارة الإدارية، سواء بخطأ منها أو دون خطأ. ويكفي أن يثبت المتضرر أن الضرر الذي أصابه قد تسببت فيه الإدارة نتيجة نشاطها الضار المادي أو القانوني. The administrative reparation law suit in the field of reconstruction is considered one of the most important lawsuits, using the protection it represents for the rights of individuals in the face of harmful material and legal administrative acts, which the party injured person goes before the judicial authority to demand compensation for various damages. For this process to be accepted, a set of formal and material conditions must be met, and it must be based on the increase in responsibility of the administrative service, whether by fault or without fault. It is sufficient for the victim to prove that the damage he has suffered was caused by the administration because of his harmful material or legal activity.
