Résumé: شهدت الأسس القانونية التي تقوم عليها المسؤولية المدنية لحماية المياه والأوساط المائية تطورا وتحديثا في ظل القانوني البيئي فرضته خصوصية الأضرار البيئية الناشئة عن جريمة تلويث المياه والأوساط المائية التي تفتك بالبيئة المائية، بصورة يصعب على المتضررين البيئيين تحديد المسؤول عن آثارها لذلك جاءت هذه الدراسة القانونية لتسلط الضوء على الانتقال أو التحول الذي طرأ على الأسس القانونية التي تحكم المسؤولية المدنية في المجال البيئي من أسس قانونية تقليدية تدخليه حيوية للمسؤولية المدنية عن الضرر البيئي المائي التي لا تبحث إلا في جبر الضرر إلى أسس قانونية حديثة وقائية للمسؤولية المدنية عن الضرر البيئي المائي .
