رد المبيع بالإقالة دراسة في قانون المعاملات المدنية الإماراتي مقارنه بالفقه الإسلامي

Résumé: تناولت الدراسة الأحكام الفقهية والقانونية في مسائل رد المبيع بالإقالة وأثرها على طرفي العقد (البائع، المشتري) وقد انتهج الباحث المنهج الوصفي والتحليلي والمقارن وقد أسفرت الدراسة عن نتائج من أهمها أجاز القانون المدني الإماراتي الاتفاق على أن يعتبر العقد مفسوخا من تلقاء نفسه دون حاجة الى حكم قضائي وذلك عند عدم الوفاء بالالتزامات الناشئة عنه واعتبر القانون هذا الاتفاق لا يعفي من الأعذار الإ في حالة اتفاق المتعاقدين صراحة على الإعفاء منه وخلصت الدراسة إلى توصيات من أهمها توصية للمشرع الإماراتي بإضافة الموضوعات المتعلقة بالخيارات التي لم تناولها في القانون المدني الإماراتي لسنة 1985م. ( عقد البيع- رد المبيع- الإقالة – قانون المعاملات المدنية الإماراتي- الفقه الإسلامي) ABSTRACT This study deals with jurisprudence and legal provisions handled in the Sale response. It also, demonstrates that influence on the parties in case of seller and purchaser. The writer of this study employs both descriptive and comparative methods since the study attempts to produce the findings of the most significant civil law agreement processed in the UAE as it revokes the contract without referring to judicial law. In case of short coming to commitments agreed upon, the contract is treated cancelled if it does not meet the responsibilities emerged of the law agreement. The law does not exempt excuses that case except for unenforceable contractors’ agreement. This study concludes with recommendations to Emirati legislators by adjoining associated potions which the Emirati civil law has not been dealt with in attached the year, 1985.
