اختطاف الأطفال المفضي إلى القتل في ظل تجميد عقوبة الإعدام: دراسة شرعية قانونية

Résumé: تعتبر جريمة الاختطاف من الجرائم التي باتت تؤرق المجتمع الجزائري وتهدد استقراره، والذي تناولته الشريعة الإسلامية بالتحريم لأنه من صور الحرابة، وتناولته المنظومات القانونية بالتجريم منها القانون الجزائري والقانون الدولي لحقوق الإنسان، ولقد أدى استفحال الظاهرة التي طالت الطفولة والبراءة؛ وأذاقتهم بعد الاختطاف كل صنوف التعذيب والتنكيل والاغتصاب وحتى الحرق ثم القتل؛ مما ألجأ المشرع الجزائري إلى التشديد في العقوبة، والتي وصلت إلى الإعدام في أربع حالات، موافقا في ذلك الشريعة الإسلامية في حالة القتل، إلا أنّ المحاكم تقضي بها ولا تنفذها؛ مما يراها البعض هدرا لدم الضحية وتجاوزا لحقها في القصاص، بعقاب الجاني بجزاء من جنس الفعل وبالمقابل يراها البعض عقوبة قاسية غير إنسانية تستوجب الإلغاء. Kidnaping is one of the most awful crime .This horrible transgression affected deeply the Algerian society and can threat its stability . In fact, this problem is treated by the Islamic legislation and stated harsh punishment to those who commit such atrocity. Therefore, it is considered as a type hiraba (type of execution) . It has been also treated by the law institutions in general and the Algerian Law in particular and considered it as a crime. The over spread of this phenomena which touch principally young people in general and children in particular. After being kidnaped they may suffer torture, rape, ill-treat and even burning. as consequence the Algerian legislation bends towards a very tough punishment which is execution in four cases similar to the Islamic legislation in case of murder. Unfortunately, this legislation is not applied as consequence which can be considered as a form of in justice towards the victims while is considered by others as a tough legislation against humanity.
