أحكام النشر الإلكتروني في البيئة الرقمية

Résumé: لقد أتاح النشر الإلكتروني إمكانية طرح اﻷﻋﻣﺎﻝ اﻟﻔﻧﻳﺔ أو اﻷدﺑﻳﺔ ﻟﻠﺟﻣﻬور ﻟﻺطﻼع ﻋﻠﻳﻬﺎ أو ﺷراﺋﻬﺎ واﻻﺳﺗﻔﺎدة ﻣﻧﻬﺎ مباشرة بعد عمليات رقمنتها وتحويل مصادر المعلومات من الشكل الكلاسيكي إلى مجموعات متاحة على وسائط رقمية حديثة الأمر الذي سهل تداولها من جهة وفرض تحديات قانونية تتعلق بطرق حمايتها. أضحى النشر الإلكتروني كآلية وعملية مشتقة منبثقة عن عمليات الرقمنة يشغل إهتمام أصحاب الإبداعات الذين يجرى نشر مصنفاتهم ، وذلك للإشكالات المتعلقة بحقوق الملكية الفكرية عن الأعمال المطروحة على الشبكة وكيفية حماية حقوق المؤلفين ،لذا فكافة التشريعات التي تحمي حقوق المؤلف ارتكزت على أعمال مجسدة على وسائط مادية،بينما تفلت الأعمال المطروحة على الشبكة من الحماية لأنها غير مجسدة في كيان مادي يمكن الإمساك به، الأمر الذي يستدعي ضرورة التدخل التشريعي لإحكام تنظيمه. الكلمات المفتاحية: نشر، إلكتروني ، رقمنة ، ملكية فكرية،حقوق المؤلف. Electronic publishing derivative of digitalization Abstract : The electronic publishing has allowed the possibility of developing artistic or literary workto public in order to learn or purchase and benefit from its immediately after digitazed,and transformation of information sources from classical form to digital form which has facilitated its circulation and imposed additional challenges relates to methodes of protection. The electronic publishing become process devirative of digitalization be distracted authoress which have published its legal literature and brief in view problematic of intellectual property rights for its acts posted on the website and preservation to protect royalties. Therefore all legislations which protect royalties based on acts reflected on material and physical media whereas other acts posted on the website escape from protection because it is’n based on physical entity which can catching,this problematic necessite and need legislative intervention to adjustment organized.
