دور المصالحة والوساطة في تسوية منازعات العمل الفردية والجماعية في التشريع الجزائري

Résumé: تعتبر النزاعات الجماعية والفردية من أكبر المشاكل التي تؤثر بالسلب على العمال، أو الهيئة المستخدمة، وتؤثر على صيرورة االقتصاد الوطني. ومن أجل التصدي لهذه الن ازعات والحيلولة دون وقوع أض ارر متعددة األبعاد، أقر المشرع الج ازئري في عدة قوانين وم ارسيم كان آخرها القانون 23-08 أساليب متعددة منها وقائية، وأخرى عالجية، وكذلك المرسوم التنفيذي 23-363 الذي حدد مهام الوسيط. وتعتبر المصالحة والوساطة من بين األساليب الودية اإلجبارية لتسوية النزاعات الجماعية والفردية، وهما طريقتان عالجيتان تقربان بين وجهات نظر طرفي النزاع، واقتراح الحلول الممكنة في شكل محاضر وتوصيات. الكلمات المفتاحية: عالقات العمل الجماعية، عالقات العمل الفردية، الطرق العالجية للتسوية، المصالحة، مكتب المصالحة، مفتش العمل، الوساطة، الوسيط. Abstract: Collective and individual conflicts are considered one of the biggest problems that negatively affect workers, or the employing body, and affect the development of the national economy. In order to address these conflicts and prevent multidimensional damage, the Algerian legislator approved in several laws and decrees, the most recent of which was Law 23-08, various methods, including preventive and remedial ones, as well as Executive Decree 23-363, which specified the tasks of the mediator . Reconciliation and mediation are considered among the obligatory amicable methods for resolving collective and individual disputes. They are two therapeutic methods that bring the viewpoints of the two parties to the conflict closer together and suggest possible solutions in the form of reports and recommendations .
