الإطار التشريعي للعقود النموذجية الدوليـة

Résumé: أصبح من الواضح أن التجارة الدولية تحتل مركز الصدارة في العلاقات الدولية الحديثة، وتعتبر المحور الرئيسي الذي تدور حوله هذه العلاقات ولا بد أن هذا التطور بحاجة ماسة إلى متابعة قانونية تضبط صيغ التعاملات التجارية الدولية، ووضع قواعد قانونية جديدة تتماشى مع التطورات العلمية التي يشهدها مجال التعامل التجاري الدولي. وفي ظل هذه التطورات في المجتمع التجاري الدولي أصبحت العقود البسيطة لا تفي بمتطلبات هذه التجارة، ومن هنا أجمع المتعاملين في هذا المجال ورجال القانون على ضرورة وجود آليات قانونية جديدة لمواكبة التطورات المتلاحقة في ميدان التجارة الدولية، خاصة بثبوت محدودية قواعد الاسناد الوطنية على الالمام بجميع حاجيات عقود التجارة الدولية. ومن هنا ظهرت العقود النموذجية للتجارة الدولية لتأطير مختلف المعاملات التجارية الدولية ومسايرة التطورات التي قد تطرأ في هذا المجال. It has become clear that international trade is at the center of modern international relations, and is the main focus of these relations. This development needs urgent legal follow-up that will adjust international trade formulas and the development of new legal rules in line with the scientific developments in international trade. In the light of these developments in the international trading community, simple contracts have not met the requirements of this trade, and hence the international trade operators and jurists are unanimous on the need for new legal mechanisms to keep pace with the successive developments in the field of international trade. It is particularly important to establish that national attribution rules are limited to the knowledge of all the needs of international trade contracts. Thus, model contracts for international trade have emerged to frame various international trade transactions and to keep pace with developments in this area.
