تطــور التحكيــم التجـــاري الدولـــي في القانون الجزائــــري

Résumé: يروم موضوع الدراسة تسليط الضوء على موقف المشرع الجزائري من " التحكيم التجاري الدولي " الذي يمثل الوسيلة القانونية المثلى لحل المنازعات التي تنشأ بشأن العقود التجارية الدولية، والذي شهد تبايناَ كبيراَ بين عدم " الإعتراف " و " التحفظ"، وصولاً إلى " الإعتراف الصريح ". مع الإشارة إلى بعض النماذج العملية للإتفاقيات التحكيم التجاري الدولي التي كانت الجزائر طرفاً فيها. كل هذا سيكون محلاً للمعالجة في الدراسة الموسومة بـــ " تطور التحكيم التجاري الدولي في الجزائر". The aim of this study is to determine the position of the Algerian legislator regarding "international commercial arbitration," which represents the optimal legal means for resolving disputes arising from international commercial contracts. This position has witnessed significant variation, ranging from a lack of "recognition" and "reservation" to "explicit recognition." The study will also refer to some practical examples of international commercial arbitration agreements in which Algeria has been a party. All of this will be addressed in the study titled "The Evolution of International Commercial Arbitration in Algeria Law .
