النظام القانوني للمسؤولية الدولية الجنائية للأفراد في إطار القانون الدولي الإنساني

Résumé: إن القانون الدولي الجنائي يدخل في إطاره الاعتراف بالمسؤولية الدولية الجنائية للأفراد، أما القانون الدولي الإنساني فيدخل في إطاره هو الآخر المسؤولية الدولية الجنائية للأفراد، وهي المسؤولية الناتجة عن انتهاكات قواعد هذا القانون. و القانون الدولي الإنساني الذي تترتب عليه المسؤولية الدولية الجنائية الفردية، ينطوي على نطاقين : النطاق المادي و النطاق الشخصي، فأما النطاق المادي يتطلب منا البحث في أنواع النزاعات التي يمكن أن تترتب عليا انتهاكات في القانون الدولي الإنساني و التي يترتب عليها كذالك المسؤولية الجنائية الدولية للفرد، أما النطاق الشخصي فيتطلب منا البحث في فئات الأشخاص الذين ينطبق عليهم القانون الدولي الإنساني. International criminal law includes recognition of the international criminal responsibility of individuals, as for international humanitarian law, it also includes the international criminal responsibility of individuals It is the responsibility resulting from violations of the rules of this law. International humanitarian law, which entails individual international criminal responsibility, has two scopes, physical domain and the personal domain, as for the physical scope, we need to research the types of conflicts that may result in violations of international humanitarian law, which also entails the international criminal responsibility of the individual, as for the personal scope, we need to research the categories of persons to whom international humanitarian law applies.
