تدابير استرداد عائدات الفساد المالي والإداري في ظل إتفاقية الأمم المتحدة لمكافحة الفساد

Résumé: ملخص: يعتبر موضوع استرداد عائدات الفساد المالي والإداري من القضايا البالغة الأهمية، نظرا لما تشكله ظاهرة تهريب العائدات الإجرامية من خطورة على دولة المنشأ، وهذا الإجراء حسب فقهاء القانون الدولي قد فتح آفاق جديدة في الحرب ضد الفساد، ومن أجل ذلك أولت إتفاقية الأمم المتحدة لمكافحة الفساد لمسألة استرداد الأصول أهمية كبيرة، حيث أفردت لها الفصل الخامس، واعتبرت في المادة 51 منها على أنّ "استرداد الموجودات هو مبدأ أساسي في هذه الإتفاقية" وحثت الدول الأطراف على أن تمدّ بعضها البعض بأكبر قدر من العون والمساعدة في هذا المجال؛ إلاّ أنه لا مِراء بأن عملية استرداد الأموال المنهوبة ليست بالعملية البسيطة، نظرا للعقبات التي تقف حائلا أمام تحقيقها. وتعتبر الجزائر من الدول التي تواجه في الظرف الراهن تحديات كبيرة لاسترداد عائدات جرائم الفساد، وبالأخص بعد الطفرة التي شهدتها في مجال مكافحة الفساد بعد الحراك الشعبي في 22 فيفري 2019. : Abstract The issue of fighting finicial and administrative corruption is considered as a significant issue, taking into account smuggling criminal proceeds from the risk to the country of origin. According to the jurists of international law, this procedure has opened new horizons in the fight against corruption, and for that reason the United Nations Convention against Corruption has given the issue of asset recovery a great importance, as it singled out Chapter V, and considered in Article 51 of it, that "recovery of assets is a basic principle in this agreement" and it urged the States parties to provide each other with the greatest amount of help and assistance in this field; however, there is no doubt that the process of recovering the looted money isn't such a simple process, given the difficulties and obstacles that stand in the way of its realization. Algeria is one of the countries currently facing major challenges to recover the . proceeds of corruption crimes, especially after the boom in the field of anti-corruption after the popular movement on February 22nd , 2019
