Résumé: يحوز الآمر بالصرف والمحاسب العمومي صلاحيات قانونية في مجال تحصيل الإيرادات وصرف النفقات العامة، مع رقابة يمارسها المحاسب العمومي على أوامر الآمر بالصرف، وتنفيذها، وفي حالة امتناعه عن تنفيذ أوامر الدفع الصادرة عن الآمر بالصرف يمكن لهذا الأخير اللجوء لإجراء تسخير المحاسب، فيما يتحمل الآمر بالصرف المسؤولية عن النفقة موضوع التسخير، وتعفى مسؤولية المحاسب إذا صدر الأمر وفقا للشروط والإجراءات القانونية المطلوبة. يهدف البحث إلى دراسة إجراءات تسخير المحاسب العمومي من طرف الآمر بالصرف ومبررات العملية. وقد خلصنا من خلال ذلك إلى عدم وجود نص صريح يحدد العقوبة الإدارية التي تطبق في حالة رفض المحاسب العمومي الامتثال لأمر التسخير. The disburser and public accountant have legal powers in the field of revenue collection and disbursement of public expenses, with control exercised by the public accountant over the orders of disburser, and their execution, in case of his failure to execute the payment orders issued by him, the latter can resort to the procedure of harnessing the accountant, and bears responsibility for the expense, while the responsibility of the public accountant is exempted if the order is issued in accordance with the legal conditions and procedures. The research aims to study procedures harnessing of public accountant by the disburser and the process justifications. We concluded that there is no explicit text specifying the administrative penalty applied in case the public accountant refuses to comply with the harnessing order.
