الآليات القانونية لحماية الاستثمار الأجنبي المباشر في الجزائر من خلال القانون 16-09 المتعلق بترقية الاستثمار

Résumé: يعتبر الاستثمار الأجنبي أحد أهم الآليات الاقتصادية لتحقيق النمو الاقتصادي فهو بديل إستراتيجي للاستدانة من البنوك الأجنبية ،كما يساهم تحقيق فوائد في مجال التشغيل والإنتاج ونقل التكنولوجيا ،ومن أجل تشجيع الاستثمار الأجنبي المباشر في الجزائر سعى المشرع الجزائري إلى وضع الإطار القانوني لتشجيعه وفرض آليات قانونية لحمايته، من خلال تكريس منظومة قانونية ضمنها العديد من الضمانات القانونية وهو ما تجسد بالفعل من خلال قانون ترقية الاستثمار الجديد رقم 09-16 وقد خلصت هذه الدراسة إلى أن المشرع كرس للمستثمر الأجنبي العديد من الضمانات من بينها مبدأ المساواة بينه وبين المستثمر الوطني،حيث يكون للمستثمر الأجنبي نفس الضمانات التي يتمتع بها المستثمر الوطني، وكذا ضمان الاستقرار التشريعي، والذي أتاح للمستثمر الأجنبي إمكانية تحويل أمواله وجميع العائدات والأرباح المحققة من عملية الاستثمار بالجزائر. توصي هذه الدراسة بضرورة إيجاد آليات قانونية تزيد من الحرية الاقتصادية وتشجع القطاع الخاص من خلال تسهيل العمل المصرفي وتحويل رأس المال وتخفيض قيود الرسوم الجمركية والإجراءات القانونية التي تثقل كاهل المستثمرين الأجانب. Foreign investment is considered one of the most important mechanisms to achieve economic growth, as it is a strategic alternative to foreign borrowing; it also contributes in spurring the field of employment, production and technology transfer. In order to encourage foreign direct investment the Algerian legislator has establish a legal framework to encourage FDI inflow and impose legal mechanisms to protect it. By devoting a legal system that includes many guarantees, which was embodied through the new Investment Promotion Law No. 09-16 This study concluded that the legislator has devoted many guarantees to the foreign investor, among them the principle of equality between him and the national investor, where the foreign investor has the same guarantees that the national investor enjoys, as well as the guarantee of legislative stability, This study recommends the necessity of finding new legal mechanisms that increase economic freedom and encourage the private sector by easing banking and capital transfer, and reduce custom duties restrictions and legal procedures that burden the foreign investor Investment is considered as one of the most important mechanisms for achieving economic growth. Algeria is one of the developing African countries that needs capital to finance its development projects. Therefore, the Algerian decision-makers have established a legal framework for encouraging foreign investment, And imposing legal mechanisms to protect it, By devoting a legal system that includes many legal guarantees concerning foreign investment, which has been embodied through the new investment promotion law No. 16-09, this paper will discuss the issue of what extent did these guarantees contribute to attracting foreign investors?
