عقد حفظ الحق (دراسة مقارنة بين القانون الجزائري والفرنسي)

Résumé: يعتبر عقد حفظ الحق من الآليات والضمانات الجديدة التي جاء بها المشرع الجزائري من خلال عدة نصوص قانونية، حيث سبق وأن أشار إليه في الأمر رقم 76/92 المتعلق بالتعاون العقاري ثم نص عليه صراحة في القانون رقم 86/07 المتعلق بالترقية العقارية، ليلغى بعد ذلك بالمرسوم التشريعي رقم 93/03 المتعلق النشاط العقاري، ثم أعيد العمل به من جديد بموجب القانون رقم 11/04 الذي يحدد القواعد التي تنظم نشاط الترقية العقارية الذي جاء بأحكام جديدة وصارمة من أجل تنظيم وضبط علاقة المرقي العقاري بالمحفوظ له إلى غاية إبرام العقد النهائي، وكذلك تنويع صيغ بيع العقارات لمنح المواطنين فرص عديدة ومتنوعة لاقتناء السكنات، بغية القضاء على أزمة السكن التي مازالت الجزائر إلى يومنا هذا.
