الخدمة التجارية الالكترونية بين الضوابط القانونية و تحديات الواقع

Résumé: غدت التجارة الالكترونية واقعا معاشا، وانتشرت بأنواعها سواء سلع أو خدمات، كما أنها تتطور بسرعة فائقة، خاصة مع تطور الاتصالات الالكترونية التي تعد الدعامة الأساسية لهذه التجارة، هذا ما جعل المشرع يقوم بمحاولة ضبطها قانونا، حتى يتم الاستفادة من مزاياها مع محاولة تقليص المخاطر المحدقة بها. إذ يقوم مورد خدمة التجارية الالكترونية بعرض خدماته عبر موقع الكتروني ثم يقوم المستهلك باقتنائها ودفع سعرها إما إلكترونيا أو عند تقديم الخدمة، كل هذا يتم وفق الشروط والضوابط التي حددها المشرع، والتي فيها من النقص و ضرورة التعديل الكثير خاصة مع المخاطر والتحديات التقنية الموجودة في الواقع. As the supplier of the electronic commercial service offers his services through his website, then the consumer acquires it and pays its price either electronically or when providing the service, all of this is done according to the conditions and controls set by the legislator, in which there is a shortage and the need to amend a lot especially with risks and challenges the technology actually exists.
