الآليات الدولية لحماية حق الإنسان في بيئة صحية ومستدامة

Résumé: أثرت الثورة الصناعية الأولى والثانية على كافة ميادين الحياة لتطال آثارها حقل حقوق الإنسان الذي عرف أشكالا جديدة للحقوق أبرزها الحق في البيئة، ما أثار إشكالات مختلفة حوله أبرزها: مدى حماية حق الإنسان في بيئة صحية ومستدامة من خلال أعمال الهيئات الدولية الحكومية وغير الحكومية. تهدف الدراسة إلى الكشف عن دور الآليات الدولية في تجسيد حماية حقيقية للحق في بيئة صحية ومستدامة، الذي عانى من التأخير في الكشف عنه، فكان من نتائج الدراسة أن هذا الحق يعد أول أجيال حقوق الإنسان باعتباره وعاء كل الحقوق، حيث وإن لم يكن معترفا به فهو حق يجب أن يفترض وجوده؛ كما يتضح من الصكوك الدولية المعنية بالبيئة، أن الحق في بيئة صحية ومستدامة حق عرفي تولد عن الأعمال ذات الطابع الإعلاني ونشأ ضمن العرف الدولي البيئي، يثبت للإنسان ولسائر الكائنات على حد سواء، إذ أن كافة حقوق الإنسان تتم حمايتها وإعمالها لصالح الإنسان وحده عدا الحق في البيئة ينبغي حمايته لصالح الإنسان والبيئة على حد سواء. /////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////// The first and second industrial revolution affected all fields of life, Including the field of human rights, which knew a new forms of rights, most notable the right to the environment, which raised various problems around it, most notably: the extent to which the human right to a healthy and sustainable environment is protected through the work of international governmental and non-governmental bodies. The study aims to reveal the role of international mechanisms to provide real protection of the right to a healthy and sustainable environment, which suffered from delays in its revealing. One of the results of the study was that this right is considered as the first generation of human rights as it is the container of all rights, since even if it is not recognized, it is a right that must be assumed to exist; As is clear from international instruments concerned with the environment, the right to a healthy and sustainable environment is a customary right generated by acts of a declaratory nature and established within international environmental custom. It is established for humans and all other creatures alike, as all human rights are protected and implemented for the benefit of humans alone, except for the right to The environment should be protected for the benefit of both humans and the environment.
