المشاركة السياسية للمرأة الجزائرية في ضوء الإلتزامات الدولية

Résumé: الملخص: عملت الجزائر على ترقية المكانة السياسية للمرأة، تمشيا مع التزاماتها الدولية، من خلال ادراجها وتكريسها في تشريعاتها الداخلية، وعلى رأسها الدساتير، لاسيما دستور1996، وما اعقبه من تعديلات، انعكست إيجابا على مستوى المشاركة السياسية للمرأة، وعلى رأسها التعديل الدستوري في 2008، والذي نص على توسيع تمثيل المرأة في المجالس المنتخبة، التزاما ببنود الاتفاقيات الدولية، وعلى رأسها: اتفاقية سيداو(1979)، وذلك بتعزيز مكانة "التمييز الإيجابي" المعبر عليه في القانون 12-03، تطبيقا لقاعدة سموّ القانون الدّولي على القانون الداخلي. الا أن الممارسة الفعلية للمشاركة السياسية للمرأة، على هذا المستوى، كشفت عن بعض النقائص التي تحتاج، في تقديرنا، الى معالجة مستقبلا. Summary: Algeria has worked to upgrade the political status of women, in line with its international obligations, Through its inclusion and consecration in its internal legislation, on top of which is the constitutions, especially the Constitution of 1996, and the amendments that followed, it reflected positively on the level of political participation of women, on top of which is the constitutional amendment in 2008, which stipulated the expansion of women's representation in elected councils, in compliance with the provisions of international conventions, On top of it: CEDAW (1979), by strengthening the status of "positive discrimination" expressed in Law 12-03, in implementation of the rule of the supremacy of international law over domestic law. However, the actual practice of women's political participation, at this level, revealed some deficiencies that, in our estimation, need to be addressed in the future.
