الإطار القانوني للتفاوض الجماعي في تشريع العمل الجزائري

Résumé: لقد أكد المشرع الجزائري على حق العامل في التفاوض الجماعي، كآلية أوجدتها المواثيق الدولية لترقية ظروف وشروط العمل من خلال بحث الأجير والمستخدم على حلول توافقية من شأنها ترقية المستوى المعيشي للعامل وتحسين ظروف أدائه للعمل وسط بيئة عمل ملائمة. وتلعب تقنية التفاوض الجماعي دورا بارزا في صناعة القواعد القانونية التي تسري على علاقات العمل الفردية و الجماعية على حد سواء،كما تعتبر وسيلة توافقية من شأنها تقريب وجهات النظر لدى العمال و ممثليهم من جهة، وأرباب العمل و ممثليهم من جهة أخرى. Abstract : The Algerian legislature has stiessed the worker’s right to collective negociation, this mechanism created by the international conventions in order to upgrade working conditions by urging workers and employers to search for compromise solutions that will improve the living standards of workers and upgrade the performance of their work amid a favorable environment conditions. The collective negociation technique plays a prominent role in providing a legal rules that apply to individual and collective labor relations. It is also a consensual means of bringing the views of workers and their representatives on the one hand and employers and their representatives on the other.
