اليات تدخل الادارة في تنظيم المسار المهني للموظف و اثار ذلك على المصلحة العامة

Résumé: تطرقت هذه الدراسة إلى تحديد آليات تدخل الإدارة في تنظيم المسار المهني للموظف، و ما يترتب عنه من نتائج قانونية قد تمس بالمصلحة العامة. إن الهدف الرئيسي من ورائها هو إبراز الإطار القانوني لهذه الآليات من حيث تقرير حماية للموظف، و تحقيق المصلحة العامة، و استخلاص مختلف النتائج المقررة قانونيا و المكرسة واقعيا و اقتراح البديل عن ذلك. This study focuses on the identification of the intervention mechanisms of the administration in the regulation of the professional career of the employee and of its legal consequences likely to harm the public interest. The main objective behind them is to highlight the legal framework of these mechanisms in terms of determining employee protection, achieving the public interest, drawing the various legally determined conclusions that are effectively enshrined and proposing a alternative to that.
