الدور الرقابي لرئيس لجمهورية على التشريعات البرلمانية *الاعتراض على القوانين نومذجا*

Résumé: يعتبر حق الاعتراض على القوانين أحد وسائل التي تحقق التوازن بين السلطتين التشريعية والتنفيذية، كما يعد تطبيقا من تطبيقات مبدأ الفصل المرن بين السلطات، تبنته معظم النظم الدستورية في العالم من حيث المبدأ مع مغايرة في تطبيقاته. وكغيره من النظم الدستورية المقارنة، تبنى المؤسس الدستوري الجزائري حق اعتراض رئيس الجمهورية على القوانين من خلال طلب مداولة ثانية بشأنها وهو ما نصت عليه في المادة 145 من الدستور، ورتب نتيجة على ذلك تتمثل في اعتبار القانون لاغيا في حالة عدم مصادقة غرفتي البرلمان على التوالي على القانون محل الاعتراض، وهو ما تضمنته المادة 145 السابق ذكرها واكدته المادة 46 من القانون العضوي 16/12 المنظم للعلاقات البينية بين غرفتي البرلمان وبينهما وبين الحكومة. Veto over laws is one of the ways that achieve a balance between the legislative and executive branches, it is an application of the principle of separation of powers between Flex applications, most constitutional systems adopted in the world in terms of principle with the different applications. Like other comparative constitutional systems, founder of the Algerian President's constitutional veto on laws by ordering a second deliberation, which is stipulated in article 145 of the Constitution, and as a result the level that is considered the law void in the absence of the two houses of Parliament respectively authentication on the contested Law, which is contained in article 145 ex and confirmed by article 46 of the organic law 16/12 governing relations between Parliament and the room between the interface and the Government.
