الدور الرقابي للمحكمة الدستورية على دستورية الأوامر في ظل التعديل الدستوري الجزائري لسنة 2020

Résumé: تهدف هذه الدراسة الى معرفة النظام القانوني للتشريع بأوامر في ظل التعديل الدستوري لسنة 2020كاختصاص أصيل لرئيس الجمهورية من خلال البحث عن حالاته وكذا الضوابط والقيود لممارسة ذلك وابراز دور المحكمة الدستورية في الرقابة على دستورية الأوامر، وهذا ما دفعنا إلى طرح الاشكالية التالية: ما مدى فعالية رقابة المحكمة الدستورية لدستورية الأوامر؟ توصلنا إلى جملة من النتائج أهمها أن رئيس الجمهورية يخطر وجوبا المحكمة الدستورية بشأن دستورية الأوامر في حالة شغور المجلس الشعبي الوطني أو خلال العطلة البرلمانية . This study aims to know the legal system for legislation by orders in light of the constitutional amendment of the year 2020 as an original competence of the President of the Republic by searching for its cases as well as the controls and restrictions to practice it and highlighting the role of the Constitutional Court in monitoring the constitutionality of orders, and this prompted us to raise the following problem: What is the extent of the effectiveness of control ؟؟ Constitutional Court for the constitutionality of orders? We reached a number of results, the most important of which is that the President of the Republic notifies the Constitutional Court of the constitutionality of orders in the event of a vacancy in the National People's Assembly or during the parliamentary recess.
