الحجز على العقارات غير المملوكة للمدين وفق قانون الإجراءات المدنية و الإدارية الجزائري

Résumé: يهدف هذا المقال إلى توضيح و بيان الإجراءات التي جاء بها قانون الإجراءات المدنية و الإدارية الجزائري بخصوص مسألة الحجز على عقار مملوك لغير المدين ، سواء كان هذا الغير حائزا لعقار المدين المحجوز عليه بالتصرف فيه ، أو كان كفيلا له قد قدم عقاره ضمانا لوفاء المدين بدينه ، لكن تخلف هذا الأخير عن الوفاء بدينه ، يعرض عقار هؤلاء للحجز ، من طرف الدائن الحاجز من أجل استيفاء حقه من ثمن بيع العقار المحجوز بالمزاد العلني ، كما يعتبر هذا الإجراء هو إجراء استثنائي عن الإجراء الأصلي و هو حجز عقار مملوك للمدين المحجوز عليه . و في الأخير توصلنا إلى أن المشرع قد أحسن لم تطرق إلى هذين الإجراءين بالتفصيل ضمن قانون الإجراءات المدنية والإدارية بعدما كان مبهمين ضمن قانون الإجراءات المدنية الملغى ، و أزال الغموض واللبس و نقص الإجراءات بخصوصهما . The purpose of this article is to clarify and clarify the procedures set forth in the Algerian Civil and Administrative procedures Act concerning the seizure of a property owned by non-debtor, whether it is not owned by the debtor or whether it is a guarantor of the debtor's property reserved for disposal, or whether it has provided its property with a guarantee of the debtor's fulfillment of its debt. However, the latter's failure to honor its debt, the latter's property is subject to arrest by the barrier creditor in order to meet its right to sell the property reserved for public auction, and this measure is an exceptional measure of the original procedure and is the reservation of a property owned by the reserved debtor. In the end, we concluded that the legislature had improved, after having been vague in the annualized Code of Civil and Administrative Procedure, and removed ambiguity, confusion and lack of procedures.
