نظام الرخص كآلية رقابة على المؤسسات المصنفة لحماية البيئة في التشريع الجزائري

Résumé: لقد اعتمد المشرع الجزائري نظام الرخص كآلية رقابة قبلية تفرض على كل مهتم بإنشاء أو استغلال مؤسسة مصنفة، وذلك راجع لمدى أهمية تطبيق هذا التنظيم على المؤسسات المصنفة بهدف حماية البيئة من كل التأثيرات السلبية الناتجة عن عدم احترام الشروط والتدابير ذات الصلة بالشأن البيئي. ولأجل ضمان هذه الرقابة القبلية التي تعكس مبدأ الوقائية، فرض المشرع على كل مهتم ضرورة إجراء دراسة أو موجز التأثير و دراسة الخطرللحصول على رخصة الإنشاء لهذه المؤسسة، ثم رخصة إستغلالها وفق ما نص عليه التنظيم في هذا المجال. Abstract: The Algerian legislator has adopted the licensing system as a tribal control mechanism imposed on interested in establishing or exploiting a classified institution. This is due to the importance of applying this regulation to classified institutions with the aim of protecting the environment from all negative impacts resulting from non-respect of conditions and measures related to environmental affairs. In order to ensure this tribal oversight, which reflects the principle of prevention, the legislator imposed on everyone interested in the necessity of conducting a study or summary the impact and risk study to obtain a construction license for this institution, and then a license to exploit it in accordance with what the regulation stipulates in this field.
