اللجوء البيئي في ظل التغيرات المناخية: ضرورة تطوير إطار قانوني شامل لحماية المتضررين

Résumé: تُعد ظاهرة اللجوء البيئي من أبرز التحديات الإنسانية والقانونية في القرن الحادي والعشرين. يعاني اللاجئون البيئيون من غياب إطار قانوني دولي يعترف بهم، حيث لا تغطي اتفاقية جنيف لعام 1951 هذه الفئة. يهدف البحث إلى تحليل الوضع القانوني الحالي واقتراح إطار قانوني شامل لحماية اللاجئين البيئيين، باستخدام المنهج الوصفي التحليلي والمقارن. تتلخص التوصيات في إنشاء اتفاقية دولية جديدة، وتعزيز التعاون الدولي، وزيادة الوعي العالمي، ودعم الدول النامية. يُعد تطوير إطار قانوني شامل ضرورة ملحة لضمان حماية اللاجئين البيئيين وبناء مستقبل أكثر استدامة. Abstract: The phenomenon of environmental displacement is one of the most pressing humanitarian and legal challenges of the 21st century. Environmental refugees suffer from the absence of an international legal framework that recognizes them, as the 1951 Geneva Convention does not cover this category. The research aims to analyze the current legal status and propose a comprehensive legal framework to protect environmental refugees, using descriptive-analytical and comparative methods. Recommendations include establishing a new international convention, enhancing international cooperation, raising global awareness, and supporting developing countries.
