مضمون العقد بديل لركني المحل والسبب في قانون العقود الفرنسي الجديد

Résumé: يتناول هذا الطرح ما تم استحداثه في نظرية صحة العقد في التشريع المدني الفرنسي في ظل التعديل القانوني الأخير الصادر بموجب المرسوم رقم 131 لعام 2016 المؤرخ في 10 فيفري 2016، وكيف أن المشرع الفرنسي تخلى عن أهم ركنين واللذان يعتبران من ثوابت نظرية العقد، على اعتبار أن وجودهما يرجع إلى ما يفوق القرنين من الزمن، ويتعلق الأمر بكل من ركن المحل والسبب، وتم استبدالهما بركن جديد هو "مضمون العقد". إن هذا الركن الذي استحدثه المشرع الفرنسي في تعديله بموجب المادة 1128 من القانون المدني يشترط أن يكون مشروع ومؤكد، إلى جانب ركن التراضي وأهلية المتعاقدين. هذا التعديل جعلنا أمام نظرية عقد قائمة على ثلاث أركان خروجا على ما كان معروف في القانون الفرنسي القديم والذي يشترط لصحة العقد رضاء المتعاقدين، أهلية التعاقد، المحل والسبب. فإلى أي مدى سيؤثر ذلك على المشرع الجزائري؟ كلمات مفتاحية: نظرية صحة العقد، المحل، السبب، مضمون العقد. Abstract: This article, highlight what has been created in the contact validity theory the French civil legislation, in light of the last lawful amendment published in the decree 131 of 10/02/2016. Where we see that the Fre nch legislator has removed the two principal requirements considered as a constants of the contract validity theory in reason that their presence it exist since two centuries. And here we are talking about the subject – Matter and the cause which. have been replaced by a new idea called «The contact of contract» that has been used for the first time in the contracting field. This idea stated by the article1128 which stipulated that the content of the contract is legal and confirmed, in addition to the acceptance and the contractors capacity, this amendment put us in front of a contract theory based on three requirements, and not four requirements as the usual.to what extent is the Algerian legislator qffected by this?
