العمل الطبي عن بعد في ظل جائحة كورونا في التشريع الفرنسي

Résumé: لقد فرضت جائحة كورونا على الأطباء ظروف عمل لم يعاهدوها من قبل، حيث أصبحت الاستشارة عن بعد هي القاعدة واستثناءً تتم في المكاتب، ما أجبر عديد الدول لاعتماد الرعاية الصحية عن بعد. لذا فإن البحث في موضوع مسؤولية التطبيب عن بعد يعتبر من المواضيع المستجدة التي تثير إشكالات قانونية عديدة. فقد سعت جُل الدول لإيجاد أنظمة قانونية تحكم الرعاية الصحية عن بعد، والبحث عن حلول تنظم مسؤولية التطبيب عن بعد، حيث جاءت هذه الدراسة للتنقيب عن الأطر القانونية المنظمة لهذا العمل في التشريعات الوطنية والمقارنة ما يجعلنا نتساءل عن كيفية تعامل المشرع مع التطبيب عن بعد على ضوء القوانين الصادرة زمن كورونا؟ Abstract The Corona pandemic has imposed some working conditions under which the doctors have never worked before, so online medical consultations have become the rule and the exception is those that take place in offices, which has forced several states to adopt online health care system. Therefore, research on the issue of the telemedecine responsibility under those conditions of work is one of the emerging topics that raise many legal problems. Most states have tried to find legal systems that govern online health care, and to search for solutions that regulate the responsibility of the telemedecine. This study aims to search for the legal framework regulating this work in national and comparative legislation, which makes us wonder how the legislation deals with telemedicine in light of the laws issued in the time of Corona?
