مراعاة مآلات الأفعال من ضوابط الفتوى في القضايا المعاصرة

Résumé: الملخّص باللغة العربية: أولا ـ أهداف البحث: و تتمثّل فيما يأتي: * بيان حقيقة مراعاة مآلات الأفعال، و مصطلحات ذات الصلة(فقه التوقّع/ فقه التنزيل). * توضيح بعض مظاهر مراعاة مآلات الأفعال في القرآن الكريم و السنة النبوية و فقه الصحابة. *ذكر علاقة قاعدة المآلات ببعض القواعد الشرعية و المقاصدية الأخرى. التعرّف على بعض فوائد الالتفات إلى قاعدة المآلات و مخاطر عدم اعتبارها . ثانيا ـ النتائج العامة للبحث: و تتمثّل فيما يأتي: *من ضوابط الفتوى مراعاة مآلات الأفعال و معناها أن ينظر المفتي في تطبيق النص الشرعي هل سيؤدي إلى مصلحة أم إلى مفسدة؟ فإن أدّى إلى مصلحة أفتى به و إلا توقّف. *النظر إلى مآلات الفعل يؤدي إلى مصالح و خير و عدم مراعاته تنجر عنه مفاسد و شرور كثيرة. *يعتبر النظر إلى المآلات من أهم ضوابط الفتوى في القضايا المعاصرة. الكلمات المفتاحية: مآلات، ضوابط، الفتوى ، القضايا، المعاصرة Summary in English: First, the search objectives are: * To show the fact that the deeds are taken into account, and the relevant terms (forecast jurisprudence/download jurisprudence). * Clarify some aspects of taking into account the fates of the deeds in the Holy Quran, the Prophet's Sunnah and the jurisprudence of the Sahaba. *Mention the relationship of the machinery rule to some of the other legal and purposeful rules. Learn about some of the benefits of paying attention to the rule of machinery and the risks of not considering it. Secondly, the general results of the research are: *One of the rules of the fatwa is to take into account the fates of the acts and mean that the Mufti should consider the application of the islamic text, will it lead to an interest or a spoiler? If it leads to an interest, I will do it or it will stop. *Looking at the deeds leads to interests and good and not taking into account it, which is dragged away by many evils and evils. *Looking at machinery is one of the most important controls of the fatwa in contemporary cases.
