أصناف الأملاك العقارية في التشريع الجزائري

Résumé: يعتبر موضوع الملكية العقارية من المواضيع العالمية التي تكتسي أهمية بالغة نظرا لما يحتله العقار من مكانة هامة في المجتمع ، فكل الدول بما فيها الجزائر تسعى إلى تنظيمها وحمايتها عن طريق إصدار العديد من التشريعات. ونظرا ما ليحتله الموضوع من أهمية بات الاهتمام واضحا من طرف الدولة في البحث عن إيجاد إستراجيات تهدف من خلالها إلى الحفاظ على الأملاك العقارية وفقا لأصنافها، فالهدف من هذه الدراسة ليس النظر في مفهوم الملكية العقارية وإنما توضيح أصنافها وتحديد مفهومها وفقا لذلك. و مفهوم الملكية العقارية في التشريع الجزائري يختلف بإختلاف صنفها، وهذا ما أكدته المادة 23 من القانون رقم 90-25 المؤرخ في 18 نوفمبر1990 المتضمن التوجيه العقاري، ومنه تصنف الأملاك العقارية إلى أملاك وطنية،أملاك خاصة وأملاك وقفية، وكل صنف من هاته الأصناف يخضع للعديد من القوانين التي تحكمه وتحدد مفهومه و صفاته وبالتالي يختلف القانون بإختلاف صنف الملكية وطبيعتها. The issue of real estate ownership is considered one of the global issues that are of great importance due to the important place real estate occupies in society. All countries, including Algeria, seek to regulate and protect it by issuing many legislations. And in view of the importance of the topic occupying it, the state's interest in the search for finding strategies aimed at preserving real estate according to its types has become clear. The aim of this study is not to consider the concept of real estate, but rather to clarify its types and define its concept accordingly. The concept of real estate ownership in Algerian legislation differs according to its type, and this is confirmed by Article 23 of Law No. 90-25 of November 18, 1990, which includes the Real Estate Directive. From it, real estate properties are classified into national properties, private properties and endowment properties, and each of these types is subject to many laws that govern it and define its concept and characteristics, and thus the law differs according to the type and nature of ownership.
