الضوابط القانونية المستحدثة لإجراء التجارب الطبية على جسم الإنسان في ضوء قانون الصحة الجزائري الجديد 18-11

Résumé: أعاد انتشار جائحة فيروس كوفيد 19 الذي ضرب العالم نهاية 2019 بداية 2020، وما خلفه من زعزعة للنظام الصحي العالمي، وكثر الحديث حول موضوع التجارب الطبية وما أثاره من جدل طبي وقانوني خاصة في هاته المرحلة التي عجز فيها الطب عن إيجاد لقاح لهذا الفيروس القاتل. إذ يسعى الأطباء والباحثون لإيجاد العلاجات المناسبة التي تنقذ البشرية من كثير من الأمراض، كما يحاولون الإجابة عن كل التساؤلات التي تدور حول الإنسان وجسده وأعضائه، كما يحاولون الوصول لأيسر السبل وأسهل الطرق لكبح الكثير من المخاطر التي تحدق بالإنسان، وهذه الغايات لن تتحقق إلا بإجراء التجارب على عينة من البشر كوسيلة للوصول لهذه الأهداف، ولكن قد تلحق هذه التجارب أضراراً بالمجرب عليهم، فتؤثر على أعضائهم فتهلكها أو تفسد وظائفها التي خلقت من أجل القيام بها. Abstract: The spread of the Covid 19 virus pandemic that truck the world at the end of 2019 started in early 2020, and the déstabilisation behind the global health system, and there was much talk about the subject of medical experiments and the medical and legal controversy it raised, especially at this stage when medicine was unable to find a vaccine for this deadly virus. As doctors and researchers seek to find appropriate treatments that save mankind from many diseases, they also try to answer all the questions that revolve around a person, his body and his organs, as they try to reach the easiest and easiest ways to curb many of the dangers that threaten a person, and these ends will only bé achieved by conducting experiments On a sample of people as a means to reach these goals, but these experiences may harm the experimenter on them, affecting their organs and destroying them or spoiling their functions That were created in order to do them.
