الضوابط القانونية المستحدثة لتقنيات المساعدة الطبية على الإنجاب في التشريعين الجزائري والمغربي The Legal Controls Introduced For Medical Assisted Reproductive Technologies In The Algerian And Moroccan Legislation

Résumé: تعتبر تقنيات المساعدة الطبية على الإنجاب من المستجدات الطبية لعلاج ضعف الإخصاب بين الزوجين، إلا أنها في نفس الوقت تُثير عدة إشكالات قانونية دينية وأخلاقية، الأمر الذي يتطلب نصوصاً تنظيمية للإجابة عنها. تنصب هذه الدراسة على مقارنة الضوابط القانونية المستحدثة لهذه التقنيات في القانون 18/11 المتعلق بالصحة في الجزائر، وكذا ظهير شريف رقم 1.19.50 المتعلق بتنفيذ قانون المساعدة الطبية على الإنجاب في المغرب. Medical assisted reproductive technologies are considered a novelty to treating fertility impairment between spouses, but at the same time they raise several legal religious and moral issues which requires regulatory texts. we highlight the comparison of legal controls developed for these techniques in Law 18/11 Related to health in Algeria, as well as the Dahir No. 1.19.50 related to the implementation of the Reproductive Medical Assistance Act in Morocco.
