السياسة العقابية للمشرع الجزائري في جريمة الاتجار بالأشخاص

Résumé: تشكل جريمة الإتجار بالأشخاص تهديدا صارخا لحقوق وحريات الإنسان، فهي ظاهرة عالمية لاتقف عند أي حدود جغرافية أو سياسية أو دينية، أفرزتها حركة العولمة ويتقاسم نتائجها العالم بأسره باعتبارها صورة من صور الإجرام المنظم. تصدرت إهتمام المجتمع الدولي، فصنفتها الأمم المتحدة كثالث أكبر تجارة دولية غير مشروعة بعد الإتجار بالسلاح والمخدرات، مما أدى إلى إبرام إتفاقيات دولية متعددة تمنع وتعاقب على الإتجار بالأشخاص، كان أهمها بروتوكول باليرمو المكمل لإتفاقية الجريمة المنظمة عبر الوطنية. ترتكب هذه الجريمة ضد الفئات الضعيفة من المجتمع من أطفال و نساء. ونظرا لخطورة آثارها، إنتهجت الدول المصادقة على البروتوكول، منها الجزائر، سياسة عقابية تتماشى مع مضمون أحكامه ، فشدد المشرع في العقاب لردع الجناة وحماية ضحايا الإتجار. كما نص على نظام الإعفاء من العقوبة لتشجيع الكشف عن مرتكبي الجريمة و التبليغ عنها. The crime of trafficking in persons constitutes a blatant threat to human rights and freedoms. It is a global phenomenon that does not stop at any geographical, political or religious borders. It was produced by the globalization movement and its results are shared by the whole world as a form of organized crime. It topped the attention of the international community, and the United Nations ranked it as the third largest illegal international trade after arms and drug trafficking, which led to the conclusion of multiple international agreements that prevent and punish trafficking in persons, the most important of which was the Palermo Protocol completing the Transnational Organized Crime Convention. This crime is committed against vulnerable groups of society, including children and women. In view of the seriousness of its effects, the countries ratifying the Protocol, including Algeria, adopted a punitive policy in line with the content of its provisions. The legislator stressed punishment to deter perpetrators and protect victims of trafficking. It also provided for a system of exemption from punishment to encourage the detection and reporting of the authors of the crime.
