مفهوم وتكوين الممتلكات الثقافية العقارية في القانون الجزائري

Résumé: لكل أمة من الأمم ثقافتها الخاصة، تتجسد من خلال ممتلكاتها المعبرة عن معتقداتها الدينية وقيمها وعاداتها الاجتماعية واتجاهاتها السياسية. والجزائر على غرار دول العالم تهتم بممتلكاتها الثقافية ومن أجل ذلك أصدر المشرع قانونا لحماية هذه الثروة وهو القانون 98-04 المؤرخ في 15 جوان 1998المتعلق بحماية التراث الثقافي. من خلال هذه البحث تطرقت إلى الإطار المفاهيمي للممتلكات الثقافية العقارية خاصة وأن المشرع صنف الممتلكات الثقافية إلى ثلاثة أنواع: الممتلكات الثقافية العقارية والممتلكات الثقافية المنقولة والممتلكات الثقافية غير المادية. وذلك بالتطرق إلى التعريف بالممتلكات الثقافية من حيث تحديد المقصود بها من منظور القانون الدولي والقانون الجزائري وتحديد الطبيعة القانونية لهذا الملك، ثم تحديد مكوناتها وفقا للقانون حيث حددها المشرع في المعالم التاريخية والمعالم الاثرية والمجموعات الحضرية والريفية، بالإضافة إلى التطرق إلى آليات تكوين الممتلكات الثقافية العقارية كالاقتناء بالتراضي أو نزع الملكية من أجل المنفعة العمومية.... Each nation has its own culture, embodied through its possessions that express its religious beliefs, values, social customs and political trends. Algeria, like the countries of the world, cares about its cultural property. For this reason, the legislature issued a law to protect this wealth, which is Law 98-04 of June 15, 1998, related to the protection of cultural heritage. Through this research, I touched on the conceptual framework of real cultural property, especially since the legislator classified cultural property into three types: real cultural property, movable cultural property, and intangible cultural property. By addressing the definition of cultural property in terms of defining what is meant from the perspective of international law and Algerian law and determining the legal nature of this property and then defining its components according to the law, where the legislator identified them in historical monuments, archaeological monuments, urban and rural groups, in addition to addressing the mechanisms of formation of real cultural property.
