المسؤولية الدولية عن الأضرار البيئية العابرة للحدود

Résumé: تظهر المسؤولية الدولية في القانون الدولي العام في شكلين، إما مسؤولية الدول عن أنشطة لا يحظرها القانون الدولي، أو تلك الناشئة عن فعل غير مشروع دوليا. ويظهر تحليل مبادئ القانون البيئي الدولي ومبدأ السيادة وعدم التدخل أن "الضرر البيئي العابر للحدود" يمكن اعتباره نظريا فعلا غير مشروع دوليا، ناتجا عن "انتهاك التزام دولي"، مما يجعل من الممكن تحميل الدولة المسؤولية. إن الاعتراف بإضعاف المبادئ الدولية المذكورة أعلاه، وتوسيع نطاق تطبيق المبادئ المرتبطة بالبيئة، يسمح لنا بالنظر، مع الانتباه دائما لكل حالة على حدة، في إمكانية تطبيق المسؤولية الدولية عن الأفعال غير المشروعة. الأفعال المسببة لأضرار بيئية عابرة للحدود، والتي تعتبر آلية قادرة على تجاوز الحدود وحماية الأصول الطبيعية العالمية ذات المصلحة المشتركة.International responsibility in public international law appears in two forms, either the responsibility of States for activities not prohibited by international law, or those arising from an internationally wrongful act. An analysis of the principles of international environmental law and the principle of sovereignty and non-intervention shows that "transboundary environmental damage" can theoretically be considered an internationally wrongful act, resulting from a "violation of an international obligation", which makes it possible to hold the State responsible. Recognizing the weakening of the above-mentioned international principles, and the expansion of the scope of application of the principles related to the environment, allows us to consider, always paying attention to each individual case, the possibility of applying international responsibility for wrongful acts. Acts causing transboundary environmental damage, which are a mechanism capable of crossing borders and protecting global natural assets of common interest.
