مشروعية الدليل الالكتروني المستمد من التسجيل الصوتي بالهاتف النقال في الإثبات الجنائي

Résumé: ملخص: عرف العالم مع بداية القرن الواحد والعشرين تطورا تكنولوجيا هاما مس جميع ميادين الحياة لاسيما المجال المتعلق بوسائل الاتصال، أين تم اختراع العديد من التقنيات التي تساهم في الكشف عن الجريمة أهمها "جهاز الهاتف النقال"، إذ لم يعد استخدامه قاصرا على تسهيل التواصل بين الأفراد بل أصبح أداة مهمة لمواجهة الجريمة المنظمة وضبط مرتكبيها، وذلك بالتنصت على محادثاتهم وتسجيلها من أجل الحصول على الدليل الجنائي الالكتروني، إلا أن التنصت على المحادثات التليفونية قد عرض في العديد من الأحيان حق الإنسان في المحافظة على حياته الشخصية للخطر، وذلك باقتحام خلوته وتجريده من كل أسراره دون أن يشعر بشيء مما يجري حوله ويقع عليه ويمس أخص خصوصياته، فأدى هذا الأمر إلى البحث في مدى مشروعية هذه التسجيلات في الإثبات الجنائي. من هذا المنطلق تهدف هذه الدراسة إلى الوقوف على المقصود بالتسجيل الصوتي بالهاتف النقال وتحديد مشروعية الدليل الالكتروني المتحصل عليه من هذا التسجيل في الإثبات الجنائي. Abstract: know the world with the beginning of the twenty-first century important technological development touching all areas of life especially the field related to by means of communication, where was it invented? many Technologies that contribute to detecting crime are the most important mobile device, it is no longer used limited to facilitate communication between individuals it became an important tool to counter organized crime and arrest the perpetrators, by eavesdropping on their conversations and recorded in order to get electronic forensic evidence, except for eavesdropping on phone conversations may be endangered many times human right in preserving his personal life and that breaking into his solitude and strip it of all his secrets without feeling anything that is going on around and falls on it and touches his most private, This led to this to search in range the legality of these recordings in criminal evidence. From this point, This study aims to stand on purpose voice recording on a mobile phone to determine the legality of electronic guide obtained from this recording in criminal evidence.
