مدى حظر المشرع للعقود الخاصة غير منتهية المدة. The Extent To Which The Legislator Bans Unlimited Term Private Contracts.

Résumé: تهدف الورقة البحثية إلى معالجة إشكالية العقود غير منتهية المدة، كون أن العقد يعد أهم وسيلة قانونية لربط الالتزامات بين الأشخاص، و نص المشرع على أحكامه العامة في القانون المدني، كما نص على مختلف العقود الخاصة كل على حدى سواء في القانون المدني أو في قوانين أخرى. فالعقود الزمنية باعتبارها شائعا في معاملات الاشخاص، إنها يمكن أن تبرم لمدة محددة و يمكن أن يحصل أن لا يتفق الأطراف على المدة أو يبرمونها لمدة غير منتهية الزمن و أبدية. الإشكالية التي لم ينظم حكمها المشرع صراحة في الأحكام العامة للعقد في القانون المدني، رغم أنه عالجها بالمنع في مجمل العقود المدنية المحضة، و لهذه القاعدة استثناءات أين أجاز في بعض العقود ابرامها لمدة غير محددة لاعتبارات أخرى غير مالية محضة. This paper aims to treat the problematic of unlimited term contracts, considering the contract is a legal means that binds obligations between persons, its common rules are stipulated in the civil code, also there is a special regulation of deferent civil contracts in other laws, and among the contracts there is time contract, which can be concluded for a limited period or it can be concluded with no definite period or sometimes the parties agree to eternal obligation. The problematic that isn’t handled by the Algerian legislator in the common rules of contract in civil code, even if he regulated it in the rules of special civil contracts by banning, but exceptionally he allowed some unlimited contracts for non pecuniary reasons.
